Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and BankCheap ("BankCheap," "we," "us," or "our") governing your access to and use of our website, calculators, content, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract under U.S. law to use the Service. By using the Service, you represent that you meet these requirements.

Some features may require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any law
• Scrape, crawl, or harvest data except as expressly permitted
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the Service, networks, or security features
• Use bots, automated tools, or AI agents to submit fraudulent inputs or applications
• Misrepresent your identity, affiliation, or eligibility for any product
• Upload anything unlawful, infringing, defamatory, or harmful
• Resell, sublicense, or commercially exploit the Service without our written consent

Content on the Service, including rates, fees, rankings, and calculator outputs, is provided for general informational and educational purposes only and does not constitute financial, investment, legal, tax, or accounting advice. The Service displays information about, and links to, financial products and services offered by third parties. Those products are subject to the provider's own terms, rates, fees, disclosures, and eligibility requirements, which control over anything shown on BankCheap. We are not responsible for the availability, accuracy, or conduct of any third-party product or site.

The Service and its content (excluding user-provided and third-party content) are owned by BankCheap or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

If you submit feedback, suggestions, corrections, or other content to BankCheap, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display that content in connection with operating and improving the Service. You represent that you have the right to grant this license and that your submissions do not violate any law or third-party right.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that rates, fees, eligibility criteria, or other product information displayed on the Service is current, complete, or accurate. Always verify with the provider before making a financial decision.

To the maximum extent permitted by law, BankCheap and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Service is limited to one hundred U.S. dollars (US $100).

You agree to indemnify, defend, and hold harmless BankCheap and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Nothing in these Terms limits any non-waivable rights you may have under the laws of your state of residence.

Most concerns can be resolved quickly by emailing legal@bankcheap.app. If we can't resolve a dispute informally within sixty (60) days, you and BankCheap agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the English language, seated in Delaware (or by remote hearing where available).

You and BankCheap each waive the right to a trial by jury and to participate in a class action. Disputes must be brought in an individual capacity only. You may opt out of this arbitration provision by emailing legal@bankcheap.app within 30 days of first accepting these Terms.

Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction.

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, for material changes, provide additional notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.

These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and BankCheap regarding the Service. If any provision is held unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
